  1. Overview

Rivet Systems Inc. ("we," "our," or "us") operates Auto-Response Voicemail™. These Terms of Service ("Terms") govern your access to and use of our website, SMS services, and related products (collectively, the "Service").

By using Auto-Response Voicemail, you agree to these Terms. If you do not agree, please do not use the Service.

  1. The Service

Auto-Response Voicemail provides missed call management tools that help professional offices respond to callers and manage voicemail communications.

The Service includes:

  • Missed-call capture and automatic text replies to callers

  • Voicemail recording, transcription, and classification

  • A shared visual voicemail inbox accessible from any smartphone

  • SMS notifications to office staff

  • Message forwarding and conversation delivery to your chosen number or device

Auto-Response Voicemail does not replace your phone system. It operates alongside your existing phone system using call forwarding.

  1. Eligibility

To use Auto-Response Voicemail, you must:

  • Be at least 18 years old (or the legal age in your jurisdiction)

  • Use the Service for lawful business purposes

  • Have the authority to bind your organization to these Terms

  1. Free Trial and Subscriptions

4.1 Free Trial

New users may begin with a 30-day free trial, no credit card required. The trial is intended for evaluation and may include limited features or usage caps.

4.2 Subscription and Billing

After your trial, continued use requires a paid subscription. Billing is handled securely through Stripe. By subscribing, you authorize Rivet Systems Inc. to charge your chosen payment method each billing cycle until you cancel.

4.3 Cancellation

You may cancel your subscription at any time by contacting us at adam@autoresponsevoicemail.com. Cancellations take effect at the end of the current billing period. No prorated refunds are provided unless required by law.

  1. Acceptable Use

You agree to use Auto-Response Voicemail responsibly and in compliance with applicable laws, including Canada's Anti-Spam Legislation (CASL) and, where relevant, U.S. TCPA regulations.

You may not use the Service to:

  • Send unsolicited or fraudulent messages

  • Harass, threaten, or deceive others

  • Infringe on third-party rights

  • Attempt to reverse engineer, resell, or misuse the Service

Violation of this section may result in suspension or termination of your account.

  1. Data, Privacy, and Messages

By using Auto-Response Voicemail, you consent to our Privacy Policy.

You retain ownership of the content of your communications. Rivet Systems Inc. acts as a processor and transmission agent only.

To provide the Service, we work with trusted third-party providers:

  • Twilio — call and text message routing

  • Stripe — payment processing

  • Hosting partners — secure data storage and uptime monitoring

SMS Messaging Program:

  • Program name: Auto-Response Voicemail

  • When a caller reaches your office voicemail, they receive one automated informational SMS with your office-approved message. Message frequency varies based on call volume and whether callers respond back. Message and data rates may apply.

  • Reply STOP to opt out of messages. Reply HELP for support or contact adam@autoresponsevoicemail.com.

Consent and Opt-In: Consent to receive SMS messages is implied under Canada's Anti-Spam Legislation (CASL, S.C. 2010, c. 23). Under CASL Section 6(6)(a), an electronic message sent in response to a request, inquiry, or other communication initiated by the recipient is exempt from express consent requirements. When a caller dials the office phone number and reaches the Auto-Response Voicemail system, they are initiating contact with the business. The automated SMS response is a direct reply to that initiated contact — acknowledging the call, providing office hours, and confirming the message was received.

No messages are sent to anyone who has not called. No prior registration, web form, or written consent is required. Message frequency is limited to one transactional response per call within a cooldown window to prevent duplicates. No marketing or promotional messages are sent at any time.

All messages include the business name and contact information as required under CASL Section 6(2). Recipients may reply STOP at any time to opt out of future messages. Reply HELP for support or contact adam@autoresponsevoicemail.com.

Message and call data are processed and stored securely in accordance with our Privacy Policy.

  1. Service Availability

Auto-Response Voicemail strives for continuous uptime, but temporary interruptions may occur due to maintenance, upgrades, or network issues outside our control (e.g., carrier outages).

We are not liable for loss of business or revenue due to such interruptions.

  1. Limitation of Liability

To the maximum extent permitted by law:

  • Auto-Response Voicemail is provided "as is" and "as available."

  • We make no warranties, express or implied, regarding uninterrupted service or specific business results.

  • In no event shall our total liability exceed the amount paid by you in the 3 months preceding the event giving rise to a claim.

You are responsible for ensuring compliance with all laws applicable to your communications and patient data.

  1. Termination

We may suspend or terminate your access if:

  • You violate these Terms or applicable laws

  • Your account is inactive for extended periods

  • We are required to do so by law or network partners

Upon termination, your right to use the Service ceases immediately. Data may be retained for record keeping or legal purposes as described in the Privacy Policy.

  1. Intellectual Property

All intellectual property related to Auto-Response Voicemail (software, branding, website design, text, logos, and trade dress) is owned by Rivet Systems Inc. or its licensors.

You may not copy, modify, or distribute our materials without prior written consent.

  1. Indemnification

You agree to indemnify and hold harmless Rivet Systems Inc., its employees, and partners from any claims, damages, or expenses arising from:

  • Your use or misuse of the Service

  • Your violation of these Terms or applicable laws

  • Content or messages transmitted through your account

  1. Changes to These Terms

We may modify these Terms at any time. Updates will be posted on our website with a new "Last updated" date. Continued use after an update constitutes acceptance of the revised Terms.

  1. Governing Law

These Terms are governed by the laws of the Province of Ontario and applicable laws of Canada, without regard to conflict of law principles.

Disputes will be resolved in the courts located in Ontario, Canada.
